1. Business Structure
On the Horizon JW Studios operates as a sole proprietorship in the State of Georgia, United States.
By accessing this website or placing an order, you agree to these Terms & Conditions.
You must be at least 18 years of age to make a purchase.
2. Product Nature
All physical products are made-to-order through third-party fulfillment providers.
Because products are made-to-order:
All sales are final.
Orders cannot be canceled, modified, or refunded once production begins except where required by law.
3. Curated Products, Personalization & Custom Artwork
On the Horizon JW Studios offers curated design collections.
Personalization options are limited to the adjustments specified within each product listing (e.g., name, date, limited text fields).
We do not offer open custom design services beyond the curated selections displayed on this website.
We reserve the right to decline requests that fall outside the listed personalization scope.
From time to time, digital creative services (including AI-assisted artwork, animations, or stylized graphics) may be offered.
📌 Custom Artwork & Photo Submission
If you submit photos, images, or reference materials for any personalized or custom design:
You confirm that:
- You own the rights to the content or
- You have obtained full permission from the rightful owner(s)
By submitting materials, you grant On the Horizon JW Studios permission to use, edit, transform, and reproduce the content solely for the purpose of creating your commissioned artwork.
All custom artwork is a stylized artistic interpretation and may not be an exact photographic replica. Variations in detail, color, and features are part of the creative process.
You are solely responsible for ensuring that submitted materials do not infringe upon any copyright, trademark, or privacy rights.
On the Horizon JW Studios is not liable for unauthorized or improper use of submitted materials by the customer.
4. Digital Creative Services
Digital services include:
• Two (2) revision rounds
• Revisions limited to the originally agreed scope
• Additional revisions billed separately
Once final files are delivered, all digital service sales are final.
Creative labor is non-refundable.
Final artwork approval constitutes acceptance of the completed work.
5. Intellectual Property & Creative Production
All artwork, designs, graphics, branding, layout structures, and digital content remain the intellectual property of On the Horizon JW Studios.
Purchase grants a personal-use license only unless otherwise stated.
Resale, reproduction, redistribution, or commercial exploitation without written consent is strictly prohibited.
📌 Use of AI & Digital Processing Tools
Some artwork and digital designs offered by On the Horizon JW Studios are created using a combination of digital design software, artificial intelligence (AI)-assisted tools, and human artistic direction.
By submitting any images or reference materials, you acknowledge and grant permission for your content to be processed through secure third-party tools and platforms for the purpose of generating your custom artwork.
Your materials will not be used for resale, public distribution, or unrelated purposes outside of your commissioned project without your explicit consent.
While reasonable care is taken when handling submitted materials, On the Horizon JW Studios is not responsible for how third-party platforms process or store data within their own systems.
Final works are curated, refined, and approved under the creative direction of the studio.
6. Payment & Chargebacks
Payments are securely processed through WooPayments.
We do not store credit card information.
Initiating a chargeback without first contacting us for resolution may result in:
• Submission of order documentation
• Proof of delivery
• Proof of personalization approval
• Arbitration enforcement
Fraudulent chargebacks may be contested.
7. Production & Shipping
Production timelines are estimates only.
We are not responsible for:
• Carrier delays
• Weather disruptions
• Supply chain interruptions
• Customs delays
Risk of loss transfers upon confirmed delivery by the carrier.
If tracking shows “Delivered,” responsibility transfers to the customer.
8. No Warranty
All products are provided “as is” without warranties of any kind, express or implied.
Minor color variations due to screen calibration or print processes are not considered defects.
9. Limitation of Liability
To the fullest extent permitted by Georgia law:
Our total liability shall not exceed the amount paid for the product or service in dispute.
We are not liable for indirect, incidental, consequential, or special damages.
10. Indemnification
You agree to indemnify and hold harmless On the Horizon JW Studios from any claims, damages, or legal fees arising from:
• Misuse of products
• Violation of intellectual property
• Customer-provided content
• Breach of these Terms
11. Force Majeure
We are not liable for failure or delay due to circumstances beyond reasonable control, including but not limited to:
• Natural disasters
• Government actions
• Supply chain interruptions
• Carrier service failures
12. Governing Law
These Terms shall be governed by the laws of the State of Georgia.
13. Mandatory Arbitration & Class Action Waiver
Any dispute arising from use of this website or purchase of products shall be resolved exclusively through binding arbitration in the State of Georgia.
You waive the right to:
• Trial by jury
• Participation in class-action lawsuits
Disputes must be brought individually.
14. Policy Modifications
We reserve the right to update these Terms at any time. Continued use constitutes acceptance of revised terms.
